Medical malpractice can result in serious personal injury and/or wrongful death. Usually it is the result of negligence, in which the physician does not perform up to expected medical standards. The standards of conduct are based upon how a reasonable professional would have acted under similar circumstances. In other words, negligence refers to a medical doctor or other medical personnel failing to act in a manner consistent with the standard of care required of trained providers in that area. |
